Terms and Conditions for Photography Services

These Terms and Conditions govern the agreement between you ("Client") and ZEROGRAM STUDIO ("Photographer") for professional photography services. By booking our services, you agree to the following terms.

1. Scope of Services

  • The Photographer will provide photography services as outlined in the booking confirmation, including the agreed number of photographs, duration, location, and other deliverables.
  • Any additional services requested by the Client may incur additional charges.

2. Booking and Payment

  • Bookings are confirmed only upon payment of the full amount or a non-refundable deposit of 10% of the total cost for yearly contracts.
  • Yearly contracts will require to sign yearly contract additionally.
  • Payment can be made via credit card and Paypal.

3. Cancellation Policy

  • Clients may cancel their booking:
    • Up to 3 days before the service date for a full refund.
    • Between 2 days and 24 hours before the service date for a 50% refund (excluding non-refundable fees such as travel or preparation costs).
    • Less than 24 hours before the service date, cancellations are non-refundable.
  • Rescheduling requests are allowed up to 14 days before the service date and are subject to availability.

4. Image Delivery

  • Final photographs will be delivered within specified turnaround time per service via a cloud-based platform.
  • The Photographer retains the right to select and edit the final images for delivery.
  • Raw or unedited images are not provided unless agreed upon in writing.

5. Copyright and Usage Rights

  • All images remain the intellectual property of the Photographer.
  • Any commercial use of the images requires prior written consent from the Photographer and may incur additional fees.

6. Client Responsibilities

  • If the Client has any specific vision, such as desired themes, locations, or particular shots, they must communicate these details to the Photographer at the time of placing the order.
  • If permits or permissions are required for the shoot location, the Client is responsible for obtaining them.

7. Limitations of Liability

  • The Photographer will make every effort to deliver high-quality services but shall not be held responsible for:
    • Delays caused by unforeseen circumstances (e.g., weather, equipment failure, or emergencies).
    • Loss of photographs due to technical failure beyond the Photographer's control.
  • The Photographer’s liability is limited to the total amount paid by the Client for the services.

8. Rescheduling and Force Majeure

  • The Photographer reserves the right to reschedule or cancel services in the event of unforeseen circumstances (e.g., illness, emergencies, or natural disasters).
  • In such cases, a full refund will be provided, or the Client may choose to reschedule.

9. Model Release

  • By booking the photography services, the Client agrees that the Photographer may use selected images for promotional purposes (e.g., portfolio, website, or social media), unless the Client explicitly opts out in writing.

10. Dispute Resolution

  • Any disputes arising from these terms will be resolved in accordance with the laws of New Jersey.
